By accessing or using our website, registering for any program, camp, tournament, league, lesson, rental, or activity, or by entering WePlay Sports Centre premises, you agree to be bound by these Terms and Conditions and the Facility Entry, Participation, Release of Liability, Assumption of Risk & Indemnity Agreement below.

1. General Terms and Conditions

1.1 Acceptance of Terms These Terms and Conditions govern your use of the WePlay Sports Centre website and all services. If you do not agree, you must not register or use our services.

1.2 Registration and Payments All registrations require full payment at the time of booking unless a payment plan is approved. Prices are in Canadian dollars and include applicable taxes unless stated otherwise.

1.3 Refund and Cancellation Policy WePlay Sports Centre maintains a strict no-refund policy.

  • Cancellations made less than 7 days before the start of any program, camp, event, or tournament will receive no refund.
  • Cancellations made more than 7 days before the start date may be considered on a case-by-case basis.
  • Once a program has started, no refunds or credits will be issued.
  • Tryout fees, registration fees, and deposits are non-refundable.
  • If WePlay Sports Centre cancels a program, a full refund will be issued.

1.4 Facility Rules and Code of Conduct All participants must follow the Tempo Volleyball Club Codes of Conduct and all posted facility rules. Failure to comply may result in immediate removal without refund.

1.5 Photography and Media Release You grant WePlay Sports Centre permission to photograph, record, and use your image and likeness for promotional purposes without compensation.

1.6 Changes to Terms We reserve the right to update these Terms and Conditions at any time. Continued use after changes constitutes acceptance.

Facility Entry, Participation, Release of Liability, Assumption of Risk & Indemnity Agreement

IMPORTANT LEGAL AGREEMENT – READ CAREFULLY

By entering onto, accessing, attending, observing activities at, participating in activities at, registering for programming at, or otherwise using any part of WePlay Sports Centre (“WePlay”), including its indoor courts, outdoor courts, training areas, fitness areas, seating areas, washrooms, hallways, parking areas, entrances/exits, common areas, and surrounding premises, you acknowledge and agree to the following terms:

1. Assumption of All Risks You voluntarily assume all risks associated with entry onto and use of WePlay premises, including risks arising from:

  • volleyball participation
  • training activities
  • camps / clinics / tournaments
  • lessons / rentals
  • spectator attendance
  • slips / trips / falls
  • wet floors / uneven surfaces
  • collisions with players, spectators, equipment, balls, poles, nets, walls, or fixtures
  • equipment malfunction or failure
  • negligent acts of other participants
  • physical exertion
  • illness / communicable disease exposure
  • parking lot accidents
  • weather-related hazards
  • any unforeseen accident, injury, loss, or damage

These risks include serious bodily injury, permanent disability, paralysis, illness, death, and property loss.

2. Release of Liability To the fullest extent permitted by applicable law, you release and discharge WePlay Sports Centre, its owners, directors, officers, employees, contractors, coaches, volunteers, affiliates, landlords, sponsors, event operators, and representatives from any and all claims, liabilities, damages, costs, actions, demands, losses, or expenses arising from personal injury, death, illness, emotional distress, property damage, theft or loss of belongings, economic loss, or accidents occurring anywhere on WePlay property, including claims arising from ordinary negligence.

3. Entry at Your Own Risk All persons entering WePlay premises do so entirely at their own risk. You are solely responsible for your own safety, supervision of minors in your care, and conduct while on site.

4. Medical Responsibility You confirm that you (or your child) are physically fit to participate. WePlay assumes no responsibility to assess fitness or health conditions. In an emergency, WePlay may secure medical treatment at your expense. You assume full responsibility for all resulting costs.

5. Property Disclaimer WePlay is not responsible for lost, stolen, or damaged property, including phones, wallets, jewelry, sports equipment, bags, vehicles, or the contents of vehicles. Do not leave valuables unattended.

6. Parent / Guardian Responsibility Parents / guardians assume full responsibility for minors under their care, including injuries, conduct, supervision, and damages caused by the minor. Parent / guardian agrees to this waiver on behalf of the minor participant.

7. Indemnification You agree to indemnify and hold harmless WePlay from claims, damages, losses, legal fees, or liabilities arising from your conduct, your negligence, your guest’s conduct, your child’s conduct, damage caused to property, or claims brought by third parties connected to your attendance or participation.

8. Video / Photo Release You grant WePlay permission to photograph, livestream, record, and use your likeness for promotional, training, media, and commercial purposes without compensation.

9. Facility Rules Failure to follow staff instructions or facility rules may result in immediate removal without refund.

10. Binding Legal Agreement This agreement is binding upon you, your heirs, family members, estate, legal representatives, assigns, and anyone bringing claims on your behalf.

11. Governing Law This agreement is governed by the laws of the Province of Ontario and Canada. If any provision is unenforceable, the remainder remains in full force.

12. Acknowledgement By registering, attending, participating, or entering WePlay Sports Centre property, you acknowledge that you have read, understood, and agreed to this waiver and the Terms and Conditions above.
